Network Terms of Service

These Terms govern your use of the entire FuelEmpire network — including fuelempire.app and every community or tenant site operated on the FuelEmpire platform by Neon Ink LLC. Please read them together with our Network Privacy Policy.

By accessing or using any part of the FuelEmpire network, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the network. These Terms contain an arbitration clause and class-action waiver that affect your legal rights (see Disputes, law & arbitration), except where such provisions are prohibited by applicable law.

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding legal agreement between you and Neon Ink LLC ("Neon Ink," "we," "us," or "our") regarding your access to and use of the FuelEmpire network: the flagship site at fuelempire.app, all FuelEmpire-branded community and tenant sites, applications, APIs, and related offerings (collectively, the "Service" or the "network").

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. If a change is material, we will provide additional notice as required by law. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms, except where your separate consent is required. If you do not agree to the new Terms, you must stop using the Service.

2. The FuelEmpire network

FuelEmpire is a network of automotive and enthusiast communities that share a common account system, a global profile identity (your "@handle"), a garage of vehicles, and a social graph. A single account created anywhere on the network can be used across the network subject to product design and each community's configuration. These Terms apply uniformly across all network sites.

Individual communities may establish additional community rules, guidelines, or standards. Those community rules supplement — and do not replace — these Terms. Where community rules conflict with these Terms, these Terms control.

3. Eligibility & community values

You must be at least 13 years of age (or the age of digital consent in your jurisdiction, if higher) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf where required by law.

We strive to maintain a welcoming platform for enthusiasts of all backgrounds. You agree to treat other people with respect and to comply with these Terms and applicable law. Harassment, discrimination, threats, hate speech, or content that attacks or excludes others based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, medical condition, veteran status, or other protected characteristics is prohibited.

4. Accounts & security

Certain features require an account. When you register, you agree to:

  • Provide accurate, current, and complete information, and keep it updated;
  • Safeguard your credentials and devices used to access the Service;
  • Accept responsibility for all activity that occurs under your account, except where caused solely by our negligence;
  • Notify us promptly at hello@fuelempire.app if you suspect unauthorized access.

Your account and handle are used across the entire network. You may not select a handle or username that impersonates another person or entity, infringes rights, or is unlawful, misleading, or offensive. We may reclaim or require you to change handles at our discretion.

5. Your content & license to us

5.1 Your rights

You retain ownership of content you submit to the Service, including text, images, vehicles, listings, forum posts, and other materials ("User Content"), subject to the licenses below.

5.2 License you grant Neon Ink

By submitting User Content, you grant Neon Ink a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting or technical display), distribute, publicly perform, publicly display, and create derivative works solely as needed to operate, promote, and improve the Service across the network and to enforce these Terms. Because the network surfaces public content across multiple sites, you acknowledge that your public User Content may appear on fuelempire.app and on community sites. This license continues while your User Content is on the Service and ends when you delete it or close your account, except that (a) reasonable backup and residual copies may persist for a limited period, and (b) content shared with others or cached may remain visible in accordance with product design and law.

5.3 Representations

You represent and warrant that:

  • You own or have the necessary rights to grant the license above;
  • Your User Content does not violate law or third-party rights;
  • You will not upload content depicting minors inappropriately or non-consensual intimate imagery.

5.4 Moderation

We may, but are not obligated to, monitor, review, remove, or restrict User Content that we believe violates these Terms, our policies, or applicable law, or that we find objectionable. We are not responsible for User Content or conduct of other users.

6. Acceptable use & community standards

The Service works best when members participate constructively.

  • Engage respectfully, even when you disagree;
  • Stay on topic in threads and forums where context matters;
  • Credit sources and respect intellectual property;
  • Report content or behavior that appears to violate these Terms;
  • Respect privacy—do not share others’ personal information without permission.

7. Prohibited activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of export or sanctions laws;
  • Harass, abuse, stalk, threaten, or incite violence against any person or group;
  • Post sexually explicit material involving minors, or non-consensual intimate imagery;
  • Distribute malware, conduct phishing, or attempt unauthorized access to systems, accounts, or data;
  • Interfere with or disrupt the Service, networks, or security;
  • Scrape, crawl, harvest, or data-mine the Service without our prior written consent;
  • Reverse engineer, decompile, or attempt to extract source code except where law permits;
  • Circumvent rate limits, technical restrictions, or enforcement actions;
  • Create multiple accounts to evade suspension or manipulate metrics;
  • Sell, rent, or transfer your account without our consent;
  • Use automated means to post spam, manipulate rankings, or mislead users.

8. Community-operated spaces

Some areas of the network are operated by community administrators who may set additional rules, configure features, moderate content, and manage members within their community. You agree to follow applicable community rules in addition to these Terms.

Neon Ink is not responsible for the acts or omissions of community administrators or members. Enforcement actions taken within a community (such as content removal or member restrictions) are subject to these Terms and applicable law.

9. Listings & user transactions

Where classifieds, trading, or similar listing features are available, they are provided as a venue to connect users. Any transaction, negotiation, shipment, payment, or exchange is solely between the participating users. Neon Ink is not a party to user transactions, does not verify listings, and does not guarantee the quality, safety, legality, or delivery of any item. You transact with other users at your own risk and are responsible for complying with applicable laws.

10. Our intellectual property

The Service, including software, design, branding, and our proprietary content (excluding User Content), is owned by Neon Ink or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

"FuelEmpire" and related marks are trademarks of Neon Ink or its affiliates. You may not use our marks without prior written permission.

11. Copyright (DMCA)

We respect copyright. If you believe material on the Service infringes your copyright, send a notice to our designated agent at hello@fuelempire.app including, as required by 17 U.S.C. § 512(c)(3):

  • Your physical or electronic signature;
  • Identification of the copyrighted work;
  • Identification of the material claimed to be infringing and information reasonably sufficient to locate it;
  • Your contact information;
  • A statement of good-faith belief that use is not authorized;
  • A statement, under penalty of perjury, that your notice is accurate and you are authorized to act on behalf of the owner.

We may remove or disable access to material in appropriate circumstances and terminate repeat infringers where permitted by law.

12. Third-party links & services

The Service may link to third-party sites or integrate third-party services. We do not control and are not responsible for third-party content, terms, or privacy practices. Your use of third-party services is at your own risk.

13. Disclaimer of warranties

To the fullest extent permitted by applicable law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We do not endorse, verify, or guarantee User Content or transactions between users.

14. Limitation of liability

To the maximum extent permitted by law, in no event shall Neon Ink, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to use) the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the amounts you paid us for the Service (if any) in the twelve (12) months before the claim arose. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Neon Ink and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the Service;
  • Your User Content;
  • Your violation of these Terms or applicable law;
  • Your violation of third-party rights.

We may assume exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense.

16. Suspension & termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to the Service or others, or where required by law. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, dispute resolution, and general provisions) will survive termination.

Account deletion options, if available, are described in-product. Certain information may be retained as described in our Privacy Policy.

17. Disputes, governing law & arbitration (Florida)

17.1 Governing law

These Terms and any dispute or claim arising out of or relating to the Service or these Terms (including non-contractual disputes) are governed by the laws of the State of Florida, United States of America, without regard to conflict-of-law rules that would apply the laws of another jurisdiction.

17.2 Informal resolution

Before filing a claim, you agree to contact us at hello@fuelempire.app and attempt to resolve the dispute informally for at least thirty (30) days.

17.3 Binding arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use of the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect, except as modified by this Section. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

The arbitration shall be conducted in English, and the seat (legal place) of arbitration shall be Miami-Dade County, Florida. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. Judgment on the arbitration award may be entered in any court having jurisdiction.

17.4 Class action & jury trial waiver

To the fullest extent permitted by law, you and Neon Ink agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Unless both you and Neon Ink agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If a court or arbitrator holds this class-action waiver unenforceable with respect to a particular claim, then the arbitration agreement shall not apply to that claim, which must be severed and brought in court, subject to the venue provisions below; the remainder of this arbitration agreement shall remain in effect.

To the fullest extent permitted by law, you waive any right to a jury trial in any proceeding arising out of or relating to these Terms or the Service, except where such waiver is prohibited by law.

17.5 Small claims & injunctive relief

Either party may bring an individual action in small claims court in Miami-Dade County, Florida (or your county of residence if the court has jurisdiction and the matter qualifies), so long as the action remains in that court and seeks only individualized relief. Nothing in these Terms prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

17.6 Arbitration opt-out

You may opt out of this arbitration agreement by sending written notice to hello@fuelempire.app within thirty (30) days of the date you first accept these Terms (or first become subject to this version of the Terms). Your notice must include your name, email address or handle, and a clear statement that you opt out of arbitration. If you opt out, the arbitration agreement does not apply to you, but the class-action waiver may still apply to the extent permitted by law.

17.7 Venue for court proceedings

If arbitration does not apply or a dispute proceeds in court, you and Neon Ink consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, except where prohibited by law.

18. General provisions

18.1 Entire agreement

These Terms, together with our Privacy Policy and any additional terms presented in connection with specific features, constitute the entire agreement between you and Neon Ink regarding the Service.

18.2 Electronic communications

You consent to receive communications from us electronically (including email and in-product notices). You agree that such communications satisfy any legal requirement that communications be in writing.

18.3 Export

You may not use or export the Service or any underlying technology except as authorized by U.S. and other applicable export control laws.

18.4 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

18.5 No waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

18.6 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

18.7 Force majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
